Rental terms

Key terms for renting machinery, equipment, accessories and trailers.

Rental period, handover and return

The rental period begins at the agreed handover and ends when the rented item and all accessories have been returned in full. Handover and return are documented separately. Visible defects must be recorded on receipt; any faults or damage discovered later must be reported immediately. Use must cease immediately if any safety-related issue is detected.

Any extension of the rental period requires prior agreement. Late returns may incur additional charges under the agreed rental pricing structure.

Rental price, deposit and cancellation

Rental price, deposit, transport fees and additional costs are set out in the agreement or order confirmation. Unless otherwise agreed, the deposit is payable upon handover or delivery; rental fees and agreed transport costs are due on return or collection. The deposit secures amounts owed. Outstanding costs, particularly additional hours, fuel, extraordinary cleaning or damage, may be offset against the deposit upon inspection of the returned item, and any remaining balance will be refunded. Every sixth regular rental day is free. Sundays do not count as regular rental days; a rental may end on Sunday but may not begin then. All stated prices are final prices, with no VAT charged under Section 19 of the German VAT Act.

Cancellation of an already confirmed binding rental: The renter may cancel free of charge up to 48 hours before the agreed collection or delivery date. In the case of later cancellation or culpable failure to collect, we may claim actual, demonstrable losses in accordance with applicable law. Saved expenses and the possibility of renting the item to another customer are taken into account. There is no flat-rate claim for 50% or 100% of the rental fee. Any applicable statutory right of withdrawal, statutory termination rights and other mandatory consumer rights remain unaffected.

Safe and intended use

The rented item may be used only for its intended purpose, within its technical limits and in accordance with the manufacturer's instructions. Operating manuals, warnings and safety equipment must be observed. Only suitably experienced and, where required, qualified persons may operate it. Providing the item to third parties requires prior consent.

Before use, the work area, ground conditions, slopes, excavations, utilities, obstacles and other hazards must be assessed. Unless agreed otherwise, the renter is responsible for required permits, barriers and safety arrangements at the work site.

Equipment familiarisation

Any familiarisation provided by the rental company relates only to the specific equipment and does not replace legally or operationally required training, qualification, instruction or authorisation. For commercial use, the renter as employer retains responsibility for these requirements.

Care, fuel and operating hours

The rented item must be handled carefully and protected against overload, theft, vandalism and unauthorised use. Only suitable fuels and operating fluids meeting the prescribed specifications may be used. Unusual noises, warning lights, leaks or other irregularities must be reported immediately; unauthorised repairs or modifications are prohibited.

Unless otherwise agreed, one rental day includes up to 8 operating hours. Additional hours may be charged proportionally based on the agreed daily rate.

Transport and changes of location

If transporting the item independently, the renter is responsible for a suitable towing vehicle, adequate towing and nose-weight capacities, correct load securing and compliance with road traffic laws. Any change in the rented item's location must be notified to the rental company.

Faults, damage and loss

Faults must be reported immediately. Repairs or engaging third parties generally require prior consent from the rental company. In accordance with applicable law, the renter is liable for damage or loss culpably caused by the renter or persons to whom the rented item is entrusted. Normal wear and tear from proper contractual use is not compensable damage.

The rental company must be informed immediately in the event of theft, burglary, vandalism, traffic accidents, personal injury or significant property damage. The police must be contacted where legally required or necessary to safeguard claims.

Liability of the rental company

The rental company's liability is governed by statutory law. Mandatory liability, particularly for intent, gross negligence and injury to life, limb or health, remains unaffected. Statutory rights regarding defects are not excluded where such exclusion would be unlawful.

Cleaning and return condition

The rented item must be returned in a reasonably cleaned condition consistent with proper contractual use. Extraordinary soiling, especially concrete, bitumen, paint or similar adherent substances, may be charged based on the actual cleaning work required.

Enquiries, contract formation and consumer information

Selecting equipment and submitting the online form initially constitutes a non-binding rental enquiry, not a paid online booking. We review the requested period, availability and any transport costs. A binding agreement only arises after separate agreement between the parties. Before a binding agreement is concluded, we provide information on key rental terms, the total agreed price including possible transport costs and statutory consumer rights.

Statutory withdrawal and cancellation are different rights. Consumers concluding contracts solely by distance communication or away from business premises may have a statutory right of withdrawal. This right is not restricted by the cancellation rules above. Contact options and a model withdrawal form are available under Right of withdrawal & consumer rights. Consumers will receive the relevant statutory withdrawal information before entering into a binding agreement where required.

Consumer rights and individual agreements

Individually negotiated agreements take precedence over pre-formulated terms. Mandatory statutory consumer rights remain unaffected. The signed rental agreement, order confirmation and handover/return record govern each individual rental.
